ORDER OF NOTICE

To Olive Jemmott, last of 161 Delphi Street, Apt. 3, Mattapan, MA, heir of Beatrice M. Jones, and her administrator/administratrix, executor/executrix of her estate, and her heirs, assigns and successors in interest, known and unknown: The action of City of Boston Building Department v. Tavis Davis, Estate of Lucymae Mason, Laura Mason, Personal Representative, Estate of Beatrice M. Jones, Presumptive Heirs of Beatrice M. Jones, Estate of Timothy G. Shearion, and Presumptive Heirs of Timothy G. Shearion, No. 22H84CV000154 on the docket of the Housing Court Department, Eastern Division (the “Court”), has been commenced against the above named defendants and against you as a party who might have an interest in the property located at 10 Mills Street, Roxbury, MA (the “Property”). This action affects the Property. Pursuant to G.L. c. 111 sec. 127I, James J. Cotter, III has been appointed the Receiver (the “Receiver”) for the Property in order to repair the Property and make it safe or fit for human habitation. Alternatively, the Receiver may request authorization from the Court sell the Property free and clear of all encumbrances of record and of all interests, including yours, if any. If the Property is not sold, and after making such repairs, if the Receiver is not paid for his fees and expenses, he could request the Court authorize him to sell the Property free and clear of any and all interests in the Property, including yours, if any, and free and clear of all encumbrances of record. In either event, if the fees and expenses incurred by the Receiver are not paid, the Receiver will request that the Court authorize that such fees and expenses be deducted from the sale proceeds.

You are hereby summoned and required to file your written objection to the appointment of the Receiver or any action taken or to be taken by the Receiver on or before October 31, 2022 in the Court, 24 New Chardon Street, Boston, MA 02114 and to serve a copy upon the Receiver, James J. Cotter, III, P. O. Box 850711, Braintree, MA 02185. If no objection is filed by such date, the Receiver will continue to request authorization from the Court to sell the Property or to bring the Property into compliance with G.L. c. 111 sec. 127I. In either event, thereafter, he will request that he be authorized to sell the Property free and clear of all ownership interests, including yours. You are encouraged to contact the Receiver at 617 899 0549. The next hearing in the Court on this action is on November 18, 2022, which you are encouraged to attend.
