To all interested persons:

A petition has been filed by Israel M. Sanchez, Jr., 90 Homestead CIrcle, Milford, MA 03055 requesting:

Relief Sought.

  1. Judgment that legal ownership of, and to, unit 3 at 12 Millmont immediately vested into Courtney upon the death of Ronald Weston by operation of law as a result the Last Will of Ronald Weston.
  2. Judgment that sufficient title did not vest in attorney Hemingway as person representative of the estate to issue a valid and enforceable unit deed to 12 Millmont to Lisa Hendricks.
  3. Alternatively, judgment setting aside the deed from attorney Hemingway to unit 3, at 12 Millmont to Lisa Hendricks as attorney Hemingway was required to obtain a license to sell unit 3, at 12 Millmont from this Court before issuing the unit deed to 12 Millmont to Lisa Hendricks.
  4. That this Court declare a constructive trust exist over the Subject Property, with the Estate as trustee, in light of (a) the confidential relationship between Hendricks and Courtney, (b) the fact that the conveyance by the Estate was without a license to sell or authorized by this Court, and (c) as a matter of law the “short sale” to Hendricks was not “arms-length”

WHEREFORE, the undersigned prays that this Court issue a citation or order the relief prayed for above; or, for further direction, hearing or trial on the issues presented.

You have the right to obtain a copy of the Petition from the Petitioner or at the Court. You have a right to object to this proceeding. To do so, you or your attorney must file a written appearance and objection at this Court before 10:00 a.m. on March 29, 2024. This is NOT a hearing date, but a deadline by which you must file a written appearance and objection if you object to this proceeding. If you fail to file a timely written appearance and objection followed by an Affidavit of Objections within thirty (30) days of the return date, action may be taken without further notice to you.
